How a case assessment at CIV works

How a distressed bondholder case assessment runs: which documents are needed, what the assessment covers and what the holder receives.

A case assessment is analytical work over documented inputs. It does not promise an enforcement outcome and does not replace legal services; its purpose is to give the holder a clear basis for a decision.

1. Documents

The holder provides the issue documentation, proof of subscription and payment, and the record of communication with the issuer.

Completeness directly determines the quality and speed of the output.

2. Verification and analysis

Identification of the issue and issuer, the evidential basis of the claim and the state of the case are verified against publicly available information.

Only documented facts are used; hypotheses about the issuer's assets are not part of the output.

3. What the holder receives

What an assessment typically contains.

  • a summary of the established state of the case
  • identification of weaknesses in the documentation
  • a comparison of the realistic options
  • whether, and on what terms, settlement is possible

4. The decision stays with the holder

An assessment commits you to nothing. You can use the output independently or with your own lawyer.
