Pre-action demand letter: purpose and content

A general explanation of the role of a pre-action demand for an unpaid bond, its typical content and why the wording belongs to a lawyer.

A pre-action demand is the formal step by which a creditor calls on a debtor to perform before court proceedings begin. For a bondholder it is usually the last out-of-court step. The exact wording is a legal act.

Its purpose

It creates a documented demand for performance and gives the other side a final chance to settle.

It also signals that the creditor is prepared to proceed formally.

Typical content

What such a letter usually contains for a bond claim.

  • identification of creditor and debtor
  • description of the claim, including the issue and the amount
  • a summary of what was not performed, and when
  • a demand for payment within a stated period
  • notice of the next steps in case of non-performance

Why a lawyer should draft it

Wording, deadlines and delivery carry legal consequences that can affect later proceedings.

Online templates do not account for the specifics of bond documentation.

What to do with the reply

Keep every response. Even a refusal clarifies the case and belongs in the documentation.

If the issuer does not respond even to a formal demand, it is time to compare the remaining options, settlement included.

Practical next step

Before filing a claim in court, compare the expected time and cost with settling the claim today.
